Terms of Service

1. Acceptance of these terms

By creating an account, uploading documents, or purchasing a service on BhuCheQ (the "Service"), you agree to these Terms of Service. If you don't agree, don't use the Service.

2. Who we are

BhuCheQ, by InQuest Global Pvt. Ltd. temporary trading name pending registration — will become "BhuCheQ Private Limited" ("BhuCheQ", "we", "us"), Good Earth Business Bay, 308, Golf Course Rd Ext, Sector 58, Gurugram, Haryana 122098, operates the BhuCheQ website and mobile app.

3. What the Service is — and isn't

BhuCheQ provides property due diligence and verification support for residential real estate in Delhi-NCR (Haryana, Uttar Pradesh, and Rajasthan), based on documents you upload and publicly available records we check against.

The Service is not legal advice, is not a guarantee of clear or marketable title, and is not a substitute for independent verification by a licensed advocate before you complete a property transaction. Full limitations are set out in our Disclaimer, incorporated into these Terms by reference.

4. Eligibility and accounts

• You must be 18 or older and capable of entering a binding contract under Indian law.
• You're responsible for the accuracy of the information you provide and for keeping your login credentials secure.
• You're responsible for all activity under your account.

5. Uploading documents

• You must only upload documents you are legally entitled to share — either because the property is yours, or you have the owner's authorization to obtain verification on their behalf. an explicit authorization checkbox at upload time is planned but not yet live
• You grant us a license to process uploaded documents solely to generate your verification report, as described in our Privacy Policy.
• You're responsible for the authenticity of documents you upload. We do not independently verify that a document is genuine before processing it, beyond what's stated in your report.

6. Fees, payment, and cancellation

• Prices for each service tier are shown at the time of purchase.
• Payments are processed by Razorpay; BhuCheQ does not store your payment credentials.
• Basic CheQ (₹79): non-refundable and non-cancelable once purchased, as automated AI processing begins immediately on order confirmation.
• All other packages: you may cancel within 1 hour of placing your order for a full refund. Cancellation is not available after that window. fill in: partial refund policy after the 1-hour window, if any

7. Report limitations

Your verification report reflects the documents and information available to us at the time of the check, subject to the limitations described in full in our Disclaimer. By using the Service you acknowledge you've read that Disclaimer.

8. Intellectual property

The BhuCheQ platform, brand, and report format/design are our property. The report we generate for you is yours to use for your personal due diligence purposes; you may not resell or redistribute it commercially without our permission.

9. Prohibited conduct

You agree not to: upload documents you're not authorized to share; attempt to bypass or manipulate the automated scoring system; use the Service for any unlawful purpose; scrape, reverse-engineer, or resell access to the Service.

10. Termination

We may suspend or terminate your account for violation of these Terms. You may stop using the Service and request account deletion at any time — see our Privacy Policy.

11. Limitation of liability

To the maximum extent permitted by law, BhuCheQ's total liability arising from or relating to a verification report is limited to the fees you paid for that specific report. BhuCheQ is not liable for indirect, incidental, or consequential losses, including loss of the transaction value of the property itself.

This cap now matches the Limitation of Liability clause in terms-modal.js (Section 9) verbatim — no gross-negligence/willful-misconduct exception, same unqualified cap. fill in with counsel: confirm this cap. It must also match the Limitation of Liability section in the Disclaimer exactly.

12. Indemnification

You shall indemnify, defend, and hold harmless BhuCheQ and its directors, officers, employees, contractors, and affiliates against claims, losses, damages, and costs (including legal fees) arising from your use of or reliance on a Report; your breach of these terms; inaccurate, incomplete, forged, or misleading information you supplied; any third-party claim arising from your transaction; or your violation of applicable law.

13. Governing law and disputes

These Terms are governed by the laws of India. Any dispute, controversy, or claim arising out of or relating to this Agreement, the Services, or any Report, shall be governed by the Arbitration and Conciliation Act, 1996, and shall be referred to and finally resolved by arbitration administered by the Delhi International Arbitration Centre (DIAC) in accordance with its Arbitration Proceedings Rules then in force, by a sole arbitrator drawn from DIAC's Panel of Arbitrators and appointed in accordance with those Rules. The seat and venue of arbitration shall be Gurugram, Haryana. The language of arbitration shall be English. Courts at Gurugram, Haryana shall retain exclusive supervisory jurisdiction over the arbitration. Any claim against BhuCheQ must be brought within six (6) months of the date of the relevant Report, failing which it shall be time-barred.

Nothing in this clause limits your rights as a consumer under the Consumer Protection Act, 2019, including your right to approach a consumer forum or commission, regardless of this arbitration agreement.

14. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance. Material changes will be notified via email, an in-app notice, and a banner on our website.
